    1. Definition of the Term

    "E-ENGRAVING" (Electronic Engraving) refers to the high-resolution digital master file, technically optimized and signed by the artist, which represents a unique work of art (or of limited edition, if applicable).

    2. Intellectual Property (Copyright)

    The artist, Hortencio Werneck, fully retains all copyright, intellectual property rights, and moral rights over the Work, including the image, the artistic concept, and the digital file (E-ENGRAVING).

    The acquisition of the E-ENGRAVING file by the Client does NOT constitute a transfer of copyright, but rather the grant of a strictly personal and non-commercial use license, as detailed below.

    3. License Grant (Personal and Non-Commercial Use)

    By acquiring this E-ENGRAVING file, the Client receives a non-exclusive, non-transferable, and irrevocable license for the following uses:

    Permitted Uses:

    • Multiple Personal Printing: The Client may generate MULTIPLE PHYSICAL COPIES of the Work (prints, on any material) exclusively for purposes of decoration, private collecting, and gifting to third parties.

    • Digital Viewing: The Client may keep copies of the digital file on their devices (computers, tablets, smartphones) strictly for personal viewing and backup.

    • Physical Gift: Printed copies may be freely given as gifts.

    4. Strictly Prohibited Uses (Copyright Violation)

    The Client may NOT, under any circumstance, carry out or allow the following:

    • Distribution of the DIGITAL FILE: Distribute, share, sublicense, lend, rent, or transmit the digital E-ENGRAVING master file to third parties, by any electronic or physical means, including email or file-sharing platforms. (The Client may only distribute the physical printed copy as a gift, as per section 3.3).

    • Commercial Use: Use the Work (the digital file or any print thereof) for any purpose of resale, commercial profit, marketing, advertising, promotion, merchandising, or as an element of a new digital or physical product (NFTs, logos, etc.).

    • Alteration: Modify, adapt, crop, manipulate, or create derivative works from the digital file.

    5. Citations and Reviews

    Exceptions are permitted only for the use of small portions of the image or brief textual citations for the purposes of art reviews, criticism, or academic references, provided that authorship is clearly attributed to Hortencio Werneck, as provided by Brazilian law (Law No. 9,610/98).

    Note: Violation of these terms will result in the immediate revocation of the use license and will subject the infringer to applicable legal sanctions for copyright infringement.
